The words “I”, “me”, “my” and “us” mean the Buyer(s) making this purchase, the words “Coastal Spas” mean the seller, and the word “contract” means this retail contract. This contract is between the Buyer(s) and Coastal Hot Spring Spas, INC. dba. Coastal Spa & Patio. The price of the property and/or services described in the sales order is shown on the “Total” line. By agreeing to these terms and conditions this contract, I agree to purchase such property and/or services. I will pay Coastal Spas the amount on the contract plus any additional expenses according to the terms in this contract. This agreement constitutes the entire contract of the pares. Oral expression or representation by an agent of either party shall not be binding. Read this invoice carefully. If it is not on the invoice, it will not be delivered.
PRE-INSTALLATION & ELECTRICAL REQUIREMENTS
Electrical installation is NOT provided by Coastal Spas. Please refer to the manufacture’s website for detailed electrical requirements for the product purchased. Upon request, Coastal Spas would be glad to give a referral to an electrician. Coastal Spa & Patio is NOT responsible for any work done by any referrals. Permits are the buyer's responsibility and Coastal Spas does NOT have any involvement in permits.
SURFACE AND PAD REQUIREMENTS
1. The spa/swim spa/BBQ should be placed on a firm and level surface.
2. Pea gravel or stepping stones may be used only on select spas/swim spas. Please refer to the manufacture’s website for details.
3. Balconies and decks must be constructed to all current codes and should support 125# per sq. ft. for spas.
ACCESS AND CLEARANCE FOR DELIVERY
1. Clearance requirements must be 2” larger than the spa through gates, between the house and side fences, around corners & overhead clearance.
2. All debris, liming or blocking access to spa site must also be removed prior to delivery. Any trimming of trees or bushes, removal of debris, leveling of ground, or other general maintenance must also be done prior to delivery and is the responsibility of the customer. Coastal Spa & Patio does NOT lift spas over walls, fences or other obstacles or disconnect any gas lines/meters.
3. Coastal Spa & Patio does charge $200.00 to remove and dump old spas.
4. Due to issues with access and clearance, I take full responsibility for any damages of any kind that may occur.
5. If delivery is attempted and is unable to be done due to an access issue there will a charge of $350.00 for the redelivery.
6. If a crane is required to deliver the spa, charges will be the responsibility of the customer. Coastal Spas are NOT responsible for any damage caused by cranes.
REFUNDS/RETURNS/CANCELLATIONS
I understand that the seller does NOT hold down payment. I understand that the refund policy is "No Refunds", this includes the deposit. Coastal Spa & Patio will allow the exchange of undamaged products within 30 days for the product of equal or greater value. Coastal Spa & Patio does NOT pay for crane fees under any circumstance. Coastal Spa & Patio will refund the deposit if you are not approved for credit and financing was selected on the order.
ORDER/PAYMENTS
I understand that I must have at least 20% paid before the product will be ordered. I understand that the product ordered is a custom order. All products MUST be paid prior to delivery of product into your backyard. Pricing is only valid for 15 months, after 15 months pricing may increase up to 5% per year from the contract date.
Warranty
All warranties for products purchased are through the manufacture who makes the product. I understand that Coastal Spa & Patio does not warranty any products. Coastal Spas will facilitate the warranty through the manufacture, but the buyer is not required to go through Coastal Spas. Please refer to the owner's manual for detailed warranty information. There will be a small trip charge for warranty service; this is to cover travel time, gas, all vehicle expense, insurance, etc. This charge will be waived for valid claims in the first forty-five(45) days.
DELIVERY/STORAGE
I understand that Coastal Spa & Patio will try to accommodate my requested delivery date. Once my spa comes in I MUST take delivery within twenty-one (21) days. A $10 per day storage fee will be charged for each day over twenty-one (21) days past the requested delivery time. I understand that until the product is delivered to the store the delivery date can’t be confirmed and that no delivery date can be promised. Coastal Spa & Patio to guarantee an exact time/date of arrival and deliveries may be rescheduled due to rainstorms and any other variable conditions that sometimes may occur.
